Constitution of the Order of Prince Daniel of Kholm
[Preamble] Foreword to the Constitution
I, Roberto Jesus Hidalgo Carrillo, Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky and Prince Grandmaster of the Order of Prince Daniel of Kholm, after due consideration of the need to respond to the humanitarian needs of peace, justice and equality, promulgate and ratify the first Constitution of the Order of Prince Daniel of Kholm. The objective of this document is to assert this institution’s purpose and function.
Chapter I The Institution
Article 1 [Definition]
a. The Order of Prince Daniel of Kholm is a chivalric society under the protection and patronage of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky. This is a society in which the Grandmaster is and will always be the Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky. All members of this institution are vassals and subjects of the Prince Grandmaster.
b. The institution will only carry out operations which relate to aiding humanitarian needs and other chivalric duties. The rule of the Order is a hereditary constitutional monarchy, which is currently held by Roberto Jesus Hidalgo Carrillo of Kholm, the Prince Grandmaster and Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky. Thenceforward it will pass to his eldest son, one generation after another forever, unless the Prince Grandmaster in his lifetime appoints a son other than his eldest son as successor, in accordance with the provisions of the Decree on inheritance stated in the following clause.
c. All provisions governing inheritance are regulated by a special Executive Order, or if unavailable, by the article on the Dynastic Laws of the House..
d. All members of this institution are entitled to participate in affairs related to their given rank or by order of their superiors.
Article 2 [Impartiality]
The order respects all men and women from all walks of life and, therefore, will not deny anyone membership for the reason of their religion, race or any other bias. Judgments made within the order especially by the administration must be impartial, not favoring any factor that is not in play.
Article 3 [Official Language and Emblems]
a. The language to be used by the order in its official documents is English. Because of the diversity of the order, the second official languages of the order are French, Spanish and German. However the second official languages must be translated to English for better understanding and vice versa when the occasion calls for it.
b. The State flag, emblem, symbols and logos are laid down by the Princely and Grand Ducal College of Heraldry of Kholm must be approved by the Grandmaster before it can be ratified officially.
Article 4 [Jurisdiction]
All members and parts of the Order are subject to the jurisdiction of the laws of this society.
Chapter II Constituents of the Institution
Article 5 [The Prince Grandmaster]
The Prince Grandmaster is the head of the institution. The leadership is hereditary and so will pass through his eldest son, unless stated otherwise by a Decree. The Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky shall take the title of "Prince Grandmaster". However, the title is not the rank itself. The rank of the Grandmaster will be Knight Grand Cordon. There can only be one Knight Grand Cordon in the entire order. The order is subject to the decrees of the Prince Grandmaster as long as they do not conflict with the laws of chivalry and the principles of the order.
Article 6 [Invested Members]
Invested members admitted by the order or their respective Grand Priors are included within the Order. A written confirmation of their acceptance into the order by the Grandmaster, especially if not present, will be considered an investiture. All invested members are permitted to use the title of "Chevalier" or "Dame"and the appropriate postnominals.
Article 7 [Honorary Members]
Those honored by the Grandmaster as members of the order without having to apply for membership are considered members of the order. To receive an honorary membership to the order is an honor from the Grandmaster.
Article 8 [Ranks]
The following are the only 6 recognized classes and ranks, along with their sub ranks within the order in order starting with the highest and proceeding to the lowest rank.
a. Knight Grand Cordon of the Order of Prince Daniel of Kholm (Prince Grandmaster) - There can only be one person holding this rank. Only the Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky may hold this rank unless decreed otherwise.
b. Knight/Dame Grand Cross of the Order of Prince Daniel of Kholm- Only members who have given the order exceptional service may be included in this class. Knights who are elevated to the Hereditary Knight status automatically recieve this rank.
c. Knight/Dame Commander of the Order of Prince Daniel of Kholm- This rank is given to members who have showed great leadership and service.
d. Knight/Dame Officer of the Order of Prince Daniel of Kholm- This rank is given to those who hold the rank of an officer in priories or the Supreme Council.
e. Knight/Dame of the Order of Prince Daniel of Kholm- This rank is given to those who have been invested and who have agreed to follow the laws of the order and to carry out the order’s work.
f. Squire/Lady-in-Waiting of the Order of Prince Daniel of Kholm- This is the lowest rank of the order. Those who have agreed to live by the principles of the order but have not been invested yet are allowed to use this title.
Chapter III Principles
Article 9 [Chivalry]
Because this institution is a chivalric order, the order must work and carry out its obligations according to the revised laws of chivalry found in Article 14 of this constitution. Members of the order must act with chivalry, etiquette, gallantry and honor.
Article 10 [Peace]
One of the order’s most important functions is the spreading of peace around the world. Members of the order must carry out their everyday life as peacekeepers and must do everything in their power and capability to achieve world peace. The order defines itself as an army of peace, using love and understanding as weapons to achieve global cooperation.
Article 11 [Charity]
Poverty is one of the reasons for the lack of peace. Therefore, the members of the order must do something which can help the needy.
Article 12 [Social Improvement]
The order must carry out actions which can contribute to the improvement of human society. Therefore, it should support cultural, scientific and moral activities.
Article 13 [Defense of the Weak]
As members are subject to the principles of chivalry, it is important to defend those who have been wronged, abused, rejected, shunned and persecuted.
Article 14 [Revised Laws of Chivalry]
The following are the Revised Laws of Chivalry with their given explanations.
a. Thou shalt swear allegiance to and defend the House of Carrillo-Rurikovich-Tverskoi-Kholmsky.
- Because this order is a chivalric society, all members will pledge allegiance to the Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky.
b. Thou shalt defend thy belief in God and thy faith.
–The order respects all faiths and creeds because the order believes that the aims of all religions are to unite the people in their belief and unity will, in the future, give way to peace and harmony.
c. Thou shalt respect all weaknesses, and shalt constitute thyself the defender of them.
–The members of the order must defend the weak and the oppressed.
d. Thou shalt love the world in which thou wast born.
–All members must not harm the world and must do everything to protect it.
e. Thou shalt not recoil before thine enemy.
–The order considers its enemy the oppressors and those who wage war. Those who are contrary to the principles of the order and hinder the progress of the order are walls which prevent the world from achieving harmony and peace. However, there is a question of the use of violence to restore peace or to achieve any of the goals of the order. Only when all the possible peaceful means have been used should the order approve of the use of force.
f. Thou shalt make war against the enemy without cessation, and without mercy.
–The order must never stop attempting to fulfill its missions.
g. Thou shalt perform, scrupulously, thy feudal duties, if they be not contrary to the laws of thy God.
–Members of the order must not forget their duties to God, their country and the order.
h. Thou shalt never lie, and shall remain faithful to thy pledged word.
–If one promises, they must strive and do all they can to fulfill it.
i. Thou shalt be generous, and give largess to everyone.
–This is part of our effort to help the needy.
Chapter IV Establishments
Article 15 [The Supreme Council]
The Supreme Council of the Order of Prince Daniel of Kholm is formed by a group of officers who take charge of the order’s administration and internal workings. The Supreme Council Members are voted by simple majority by the members of the entire order. The committee members and chairmen are appointed by the Grandmaster or the Grand Chancellor. The following are the offices of the Supreme Council by rank:
a. Supreme Council Head
i. Office of the Prince Grandmaster of the Order of Prince Daniel of Kholm- chief executive of the order.
b. Supreme Council Members
i. Office of the Grand Chancellor of the Supreme Council- Head of Government of the Supreme Council and reports to the Grandmaster.
ii. Office of the Deputy Grand Chancellor of the Supreme Council- Second in command of the Supreme Council
iii. Office of the Grand Hospitaller of the Supreme Council- In charge of coordinating all the charitable works of the order
iv. Office of the Grand Exchequer of the Supreme Council- In charge of handling all the Supreme Council’s funds and treasury.
v. Office of the Grand Auditor of the Supreme Council- Audits the treasury of the Supreme Council.
vi. Office of the Grand Herald of the Supreme Council- In charge of public information and media.
vii. Office of the Grand Keeper of the Regalia of the Order- In charge of the distribution of the regalia.
c. Supreme Council Committees
i. Goodwill Committee- A committee appointed to create or propose charitable projects and operations for the order.
ii. Fundraising Committee- A committee in charge of finding ways to raise funds for the benefit of the projects of the order.
iii. Merit Committee- In charge of promoting or awarding Knights and Dames who have done exemplary service to the order.
d. Other Offices
i. Office of External Affairs- Supervises the Diplomatic Corps of the Order of Prince Daniel of Kholm and deals with coordinating activities outside of the order where the order is involved.
ii. Office of Information, Protocol and Verification- Provides to those who request information about the order and verifies the appointment of all officers including the Prince Grandmaster.
e. Senate of the Order - Membership is formed by the Grand Commanders of the Order. Similar to a parliament of a nation, they are the legislative assembly of the order. They have the power to enact resolutions which take effect on the entire order. They cannot however pass resolutions that will override the power or decrees of the Grandmaster and the Grand Chancellor.
Article 16 [Diplomatic Corps]
The Diplomatic Corps of the Order of Prince Daniel of Kholm is a branch of the order which deals with carrying out, but not limited to diplomatic missions by the Prince Grandmaster or the Supreme Council of the Order of Prince Daniel of Kholm. This branch or the order was created particularly so that missions will be more official and clear not only inside the order but also to the public. The Diplomatic Corps branch is under the supervision of the Office of External Affairs
a. Diplomatic Corps Delegation-In countries where priories are not present and where priories nearby cannot carry out a certain mission order, the Prince Grandmaster or Supreme Council may send out a delegation to officially represent the Order of Prince Daniel of Kholm and carry out the task. The members of the delegation must be members of the order, regardless of rank. The delegation may contain any number of individuals so long as it will not be a burden to the order or will not jeopardize the success of the mission.
b. Delegation Officers
i. Ambassador Extraordinary and Plenipotentiary - Head of an accredited diplomatic mission of the order.
ii. Ambassador-at-Large- Head of an unaccredited delegation.
iii. Envoy Extraordinary and Minister Plenipotentiary - Head of a small, unaccredited diplomatic mission.
iv. Charge d'Affaires - Deputy of the Head of the Mission and deputizes in his absence.
v. Consul - head of a consulate.
vi. Vice Consul- Deputizes in the Consul’s absence.
vii. Secretary- Officer who does general clerical and administrative work such as word-processing, filing, and arranging appointments for the delegation
c. Delegation Members- When a new member has been recruited but has not yet been invested, especially in missions to establish priories, he/she can be a member of the delegation.
d. Embassy- An embassy is the headquarters of a diplomatic mission. It is headed by an Ambassador, Ambassador-at-Large or, temporarily, a Charge d'Affaires. Consulates within a nation report to the embassy.
d. Legation- Headed by an Envoy Extraordinary and Minister Plenipotentiary. It is similar to an Embassy but headed by a lower ranking head of a mission.
d. Consulate- reports to the embassy and headed by a consul.
e. Mission Order- When sending a mission, a mission order must be submitted to the members of the delegation and if possible, to the appropriate authorities in the area of operation. The mission order must include the starting members of the delegation and the delegation’s head. It must also include the request for the delegates to be treated according to the Vienna Conventions of 1961 and 1963.
f. Authorized Missions to be Carried Out
i. Missions to Establish Priories- In missions where the objective is to establish active priories, the Consul may recruit new members and can act as an “Acting Grand Prior”. He/she may accept new recruits into the order but only as squires. All squires will automatically be Knights and Dames once the Consulate has been raised to the level of Grand Priory. The Consul will be Grand Prior but the rest of the temporary officers will be replaced by the newly elected or appointed priory officers.
ii. Goodwill Missions- Missions where the order has sent a delegation to perform a mission to carry out projects subscribing to the order’s principles (e.g. charity, medical missions etc.) are classified as Goodwill Missions.
iii. Miscellaneous Missions- Delegations officially sent to represent the order in conferences or the like or do work for the order in some way are classified as Miscellaneous Missions.
Article 17 [Priories]
A priory is a branch of the order in a certain country which carries out the works of the order. These priories are headed by Knight/Dame Commanders. The following are the kinds of priories:
a. Grand Priory - A Grand Priory is the highest form of a branch which stands on a national level. If there is only one priory within a given country, the priory will have jurisdiction over all the establishments of the order within that country. The Grand Priory is headed by a Knight/Dame Commander or a higher rank and will assume the title of “Grand Prior”. The Grand Prior acts on behalf of the Prince Grandmaster and is the representative of the Grandmaster in that country.
Article 18 [Branches of a Grand Priory]
Grand Priories may establish other priories in other parts of a country. These are termed as Priories. They will report to the Grand Priory and are subordinate to them.
Chapter V Powers
Article 19 [The Prince Grandmaster]
The Prince Grandmaster is the supreme leader of the order and therefore he is the chief executive of the order with some legislative powers. However, if the Grandmaster deems it rightful, he may pass his executive powers to the highest elected official. The order and its constituents are subject to the decrees of the Prince Grandmaster once his executive power is restored. His decrees cannot be overturned or overridden by either the Senate or the Grand Chancellor.
a. Executive Order- Since the entire order is under the authority of the Prince Grandmaster, all constituents of the order must respect his decree unless his decree does not conflict with the order’s principles, Code of Chivalry and the morals of human society. This official order must be made public and announced to all the members of the order. Disrespect and neglect of the Prince Grandmaster’s decree would result in the appropriate punishment which will be decided by the Senate or the Grandmaster himself.
b. Emergency Power- The order is also the keeper of peace. In an event where chaos and public disorder has erupted and if all possible efforts for negotiations have failed, the Senate may be dismissed to give the Prince Grandmaster absolute control of the order. However, this must only be enacted if there is a clear threat to society or the order’s peace and stability.
Article 20 [Grand Chancellor of the Supreme Council]
The Grand Chancellor holds executive power within the order in trust from the Grandmaster. He may issue Grand Chancellorial decrees with the consent of the Senate or the Grandmaster. His actions are made on behalf of the Prince Grandmaster's name. He may accept, expel, deny and promote members in the name of the Grandmaster. His decrees bear the same power as the Grandmaster's although his decrees can be vetoed by the Grandmaster.
Article 21 [Merits]
The order understands the need to award those who have done exemplary service to the order. Merits may be given by the Merit Committee, the Grand Chancellor or the Prince Grandmaster. Merits to certain members or non members may be recommended by their superiors to the Merit Committee. All merits are given in 3 grades; Commander, Officer and Knight/Dame. The following is the hierarchy of the merits given in the order from the highest:
a. Grand Cross of Chivalry- Given to Knights and Dames of the Order who have done exceptional service to the order even beyond the call of duty. It is also given to those who have dedicated their lives to the laws of chivalry.
b. Order of the Grandmaster- Given exclusively by the Grandmaster to those who have shown dedication and loyalty to order.
c. Order of the Lion- Given to those who have been injured while serving the order.
d. Star of Honor- Given to those who have demonstrated honor, the highest principle of chivalry.
e. Order of St. George- Given to those who have shown dedication in their work or while on a mission.
f. Order of Apollo- Given to those who have worked for the social improvement.
g. Order of St. Vincent de Paul- Given to those who have demonstrated generosity and charity.
h. Order of Service- Given to those who have done exemplary service to the order.
i. Honorary Ambassador of Peace - Given to non-members whose works have greatly contributed to achieving peace.
Article 22 [Vote of No Confidence]
Any person of office, except for the Grandmaster, may be removed from office through a vote of no confidence. A majority vote within the order is required to remove a person in office.
Article 23 [Ammendments]
Ammendments of the constitution or decrees can be made through petition and majority vote of the Senate or by Grand Chancellorial Decrees or Executive Orders. |
