Prince Grandmaster Roberto Carrillo (2nd Term)

 

Decree no. 2 (Order of Precedence and Provisions for Absences)The Prince Grandmaster, in his capacity as the hereditary chief executive of the order hereby promulgates these statutes:

1. In the event that an executive officer within the order has not been active in his duties for 1 week, his deputy (if available) shall take over his powers and has the right to act on his behalf.

2. If within a month from the estimated time of absence, the concerned officer has still not responded to attempts of communication, his deputy (if available) shall be automatically appointed as the Acting Officer of the Office and shall have the same powers as the concerned officer. The acting officer must be confirmed by the Grandmaster in order to be validated.

3. If within 2 months from the estimated time of absence, the concerned officer has still not responded to attempts of communication, the Acting Officer shall replace the concerned officer and shall assume the full powers vested in his office. The officer must be confirmed by the Grandmaster in order to be validated.

4. If a deputy is unavailable, the next officer in the Order of Precedence would take over the as Acting Officer without leaving his office. This provision will be applicable to the Grandmaster.

5. If the succession to office is through the Order of Precedence, if within 2 months, the concerned officer has still not responded to attempts of communication, the Grandmaster may decide to hold elections or to appoint a competent officer. If it is by appointment, the senate must approve the appointment.

6. In the event that the Grandmaster himself is incapacitated for 6 months, the Senate will have the right to remove the Grandmaster through a 2/3 majority vote. This is only applicable if the senate deems the Grandmaster incapable of fulfilling his duties. If a Grandmaster is removed, the senate will decide on whether the entire House itself will be excluded from succeeding as Grandmaster, in which case, a new House will be selected to be the patron of the order with its head as the Grandmaster. Constitutional Ammendments will be introduced to reflect this change.

Decree no. 1 (Recall Elections)
 
The Prince Grandmaster, in his capacity as the hereditary chief executive of the order hereby promulgates these statutes:

1. A reelection shall be held for the Offices of the Supreme Council and the Senate.

2. Should there be no opposition to a candidate up to the deadline for submitting candidacy, he shall be proclaimed the winner by default.

3. The eligible candidates for the Senate are only those who are Grand Priors or former Grand Priors.

4. Should there be no eligible candidates within the Senate constituency, the seat of the Senate will revert to the Grand Chancellor who will represent the constituencies without a senator.

5. There shall be no accumulation of votes.

6. In the event that a Grand Priory is created after the elections within a constituency that has its seat reverted to the Grand Chancellor due to a lack of eligible candidates during the election, that Grand Prior will be appointed as the Senator for his respective constituency.

7. There shall be created a Court of Disputes of the order. Its function is to decide upon disputes within the order. It will be headed by a Chief Magistrate who shall be assisted by 2 Magistrates. The Chief Magistrate will be appointed by the Grandmaster with approval from the senate.

Executive Order no. 1 (Status of the Order)The Prince Grandmaster, in his capacity as the hereditary chief executive of the order and as guardian of the tradition of chivalry hereby promulgates these statutes:

1. The status of the Order will be changed from a dynastic chivalric order to a chivalric society.

2. The title of knighthood issued by the order may only be used within this organization.

3. The title of "Sir" will be changed and reverted back to "Chevalier".

4. Provisions in the constitution going against this executive order will be ammended according to the proceedures laid out in Article 23 of the Constitution of the Order of Prince Daniel of Kholm.

Executive Order no. 2 (Ammendments to the Constitution)

The following ammendments will be introduced to their respective articles:

 

Chapter I The Institution

Article 1 [Definition]


a. The Order of Prince Daniel of Kholm is a chivalric society under the protection and patronage of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky. This is a society in which the Grandmaster is and will always be the Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky. All members of this institution are vassals and subjects of the Prince Grandmaster.

b. The institution will only carry out operations which relate to aiding humanitarian needs and other chivalric duties. The rule of the Order is a hereditary constitutional monarchy, which is currently held by Roberto Jesus Hidalgo Carrillo of Kholm, the Prince Grandmaster and Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky. Thenceforward it will pass to his eldest son, one generation after another forever, unless the Prince Grandmaster in his lifetime appoints a son other than his eldest son as successor, in accordance with the provisions of the Decree on inheritance stated in the following clause.

c. All provisions governing inheritance are regulated by a special Executive Order, or if unavailable, by the article on the Dynastic Laws of the House..

d. All members of this institution are entitled to participate in affairs related to their given rank or by order of their superiors.

 

Article 4 [Jurisdiction]

All members and parts of the Order are subject to the jurisdiction of the laws of this society.

 



Chapter II Constituents of the Institution


Article 5 [The Prince Grandmaster]


The Prince Grandmaster is the head of the institution. The leadership is hereditary and so will pass through his eldest son, unless stated otherwise by a Decree. The Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky shall take the title of "Prince Grandmaster". However, the title is not the rank itself. The rank of the Grandmaster will be Knight Grand Cordon. There can only be one Knight Grand Cordon in the entire order. The order is subject to the decrees of the Prince Grandmaster as long as they do not conflict with the laws of chivalry and the principles of the order.

Article 6 [Invested Members]

Invested members admitted by the order or their respective Grand Priors are included within the Order. A written confirmation of their acceptance into the order by the Grandmaster, especially if not present, will be considered an investiture. All invested members are permitted to use the title of "Chevalier" or "Dame"and the appropriate postnominals.

Article 7 [Honorary Members]

Those honored by the Grandmaster as members of the order without having to apply for membership are considered members of the order. To receive an honorary membership to the order is an honor from the Grandmaster.


Article 8 [Ranks]

The following are the only 6 recognized classes and ranks, along with their sub ranks within the order in order starting with the highest and proceeding to the lowest rank.

a. Knight Grand Cordon of the Order of Prince Daniel of Kholm (Prince Grandmaster) - There can only be one person holding this rank. Only the Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky may hold this rank unless decreed otherwise.

b. Knight/Dame Grand Cross of the Order of Prince Daniel of Kholm- Only members who have given the order exceptional service may be included in this class. Knights who are elevated to the Hereditary Knight status automatically recieve this rank.

c. Knight/Dame Commander of the Order of Prince Daniel of Kholm- This rank is given to members who have showed great leadership and service.

d. Knight/Dame Officer of the Order of Prince Daniel of Kholm- This rank is given to those who hold the rank of an officer in priories or the Supreme Council.

e. Knight/Dame of the Order of Prince Daniel of Kholm- This rank is given to those who have been invested and who have agreed to follow the laws of the order and to carry out the order’s work.

f. Squire/Lady-in-Waiting of the Order of Prince Daniel of Kholm- This is the lowest rank of the order. Those who have agreed to live by the principles of the order but have not been invested yet are allowed to use this title.

 

Article 14 [Revised Laws of Chivalry]

The following are the Revised Laws of Chivalry with their given explanations.

a. Thou shalt swear allegiance to and defend the House of Carrillo-Rurikovich-Tverskoi-Kholmsky.
- Because this order is a chivalric society, all members will pledge allegiance to the Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky.

 

Chapter IV Establishments

Article 15 [The Supreme Council]


The Supreme Council of the Order of Prince Daniel of Kholm is formed by a group of officers who take charge of the order’s administration and internal workings. The Supreme Council Members are voted by simple majority by the members of the entire order. The committee members and chairmen are appointed by the Grandmaster or the Grand Chancellor. The following are the offices of the Supreme Council by rank:

a. Supreme Council Head
i. Office of the Prince Grandmaster of the Order of Prince Daniel of Kholm- chief executive of the order.

b. Supreme Council Members

i. Office of the Grand Chancellor of the Supreme Council- Head of Government of the Supreme Council and reports to the Grandmaster.

ii. Office of the Deputy Grand Chancellor of the Supreme Council- Second in command of the Supreme Council

iii. Office of the Grand Hospitaller of the Supreme Council- In charge of coordinating all the charitable works of the order

iv. Office of the Grand Exchequer of the Supreme Council- In charge of handling all the Supreme Council’s funds and treasury.

v. Office of the Grand Auditor of the Supreme Council- Audits the treasury of the Supreme Council.

vi. Office of the Grand Herald of the Supreme Council- In charge of public information and media.

vii. Office of the Grand Keeper of the Regalia of the Order- In charge of the distribution of the regalia.



c. Supreme Council Committees

i. Goodwill Committee- A committee appointed to create or propose charitable projects and operations for the order.

ii. Fundraising Committee- A committee in charge of finding ways to raise funds for the benefit of the projects of the order.

iii. Merit Committee- In charge of promoting or awarding Knights and Dames who have done exemplary service to the order.

d. Other Offices

i. Office of External Affairs- Supervises the Diplomatic Corps of the Order of Prince Daniel of Kholm and deals with coordinating activities outside of the order where the order is involved.

ii. Office of Information, Protocol and Verification- Provides to those who request information about the order and verifies the appointment of all officers including the Prince Grandmaster.

 

e. Senate of the Order - Membership is formed by the Grand Commanders of the Order. Similar to a parliament of a nation, they are the legislative assembly of the order. They have the power to enact resolutions which take effect on the entire order. They cannot however pass resolutions that will override the power or decrees of the Grandmaster and the Grand Chancellor.

 

Article 19 [The Prince Grandmaster]

The Prince Grandmaster is the supreme leader of the order and therefore he is the chief executive of the order with some legislative powers. However, if the Grandmaster deems it rightful, he may pass his executive powers to the highest elected official. The order and its constituents are subject to the decrees of the Prince Grandmaster once his executive power is restored. His decrees cannot be overturned or overridden by either the Senate or the Grand Chancellor.

a. Executive Order- Since the entire order is under the authority of the Prince Grandmaster, all constituents of the order must respect his decree unless his decree does not conflict with the order’s principles, Code of Chivalry and the morals of human society. This official order must be made public and announced to all the members of the order. Disrespect and neglect of the Prince Grandmaster’s decree would result in the appropriate punishment which will be decided by the Senate or the Grandmaster himself.

b. Emergency Power- The order is also the keeper of peace. In an event where chaos and public disorder has erupted and if all possible efforts for negotiations have failed, the Senate may be dismissed to give the Prince Grandmaster absolute control of the order. However, this must only be enacted if there is a clear threat to society or the order’s peace and stability.

 

Article 20 [Grand Chancellor of the Supreme Council]

The Grand Chancellor holds executive power within the order in trust from the Grandmaster. He may issue Grand Chancellorial decrees with the consent of the Senate or the Grandmaster. His actions are made on behalf of the Prince Grandmaster's name. He may accept, expel, deny and promote members in the name of the Grandmaster. His decrees bear the same power as the Grandmaster's although his decrees can be vetoed by the Grandmaster.


Article 23 [Ammendments]

Ammendments of the constitution or decrees can be made through petition and majority vote of the Senate or by Grand Chancellorial Decrees or Executive Orders.

Executive Order no. 3 (Oath of Allegiance)
 
By the order of the Prince Grandmaster of the Order of Prince Daniel of Kholm, We hereby promulgate the following statute:

1. Grand Priors, Grand Commanders and Senators, Officers of the Supreme Council, Diplomats and Heads of the Offices, Committees and Commissions of the order are required to make a new Oath of Allegiance to the Prince Grandmaster to reassure their loyalty.

2. Grand Priors, Grand Commanders and Senators, Officers of the Supreme Council, Diplomats and Heads of the Offices, Committees and Commissions of the order are required to confirm their adherence to the decrees and executive orders of the Prince Grandmaster.

3. Junior members are required to assure their immediate superior of their allegiance to the office of the Prince Grandmaster through an Oath of Allegiance.

4. The text of the Oath shall be as follows:

"I pledge, by my honor, my alleigance to His Imperial Highness Prince Roberto Jesus Hidalgo Carrillo, Prince Grandmaster of the Order of Prince Daniel of Kholm, Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky, to uphold, live by and propagate the Code of Chivalry and to defend the Order, the Grandmaster and the Code of Chivalry."

5. Honorary members are exempt from this order.

Executive Order no. 4 (Leadership Restructuring and Renunciation of Office)
 

The Prince Grandmaster, in his capacity as the hereditary chief executive of the order hereby promulgates these statutes:

That there shall be created a Council of Noble Patrons that shall grant the order the patronage of the noble houses of each patron. This Council will be headed and represented by an Honorary Prince Grandmaster. All members of the council will hold the title of Noble Patron and Protector of the Order. Membership shall be hereditary and will pass to the next heir.

That the Council of Noble Patrons may act in an advisory capacity to the Prince Grandmaster-in-Chief. The views of the Council will be put forward and represented by the Honorary Prince Grandmaster to the Prince Grandmaster-in-Chief.

That admission and removal from the Council of Noble Patrons shall be decided upon by the Honorary Prince Grandmaster.

That the Honorary Prince Grandmaster will be the figurehead and chief representative of the order and that he shall not have any executive powers nor any power to interfere with the legislative or executive branches of the order. The Honorary Prince Grandmaster will be the leader of the Council of Noble Patrons and enjoys the status of primus inter pares or "first among equals".

That the Prince Grandmaster-in-Chief will have the same executive and hereditary powers held by the Prince Grandmaster in the current system. The Prince Grandmaster-in-Chief will be concerned with being the Head of Government and shall conduct the daily activities of the order. He cannot however interfere with the affairs of the Council of Noble Patrons.

That We, Roberto Jesus Hidalgo Carrillo, Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky, Prince Grandmaster of the Order shall abdicate the Office of the Prince Grandmaster and President of the Senate in favor of His Illustrious Highness Prince Timothy Mark Coulter as Prince Grandmaster-in-Chief and His Serene Highness Prince Jan Gabriel Stanislav Macak of Este - Piccolomini d'Aragona as Honorary Prince Grandmaster and Noble Patron of the Order

That We, Roberto Jesus Hidalgo Carrillo, Head of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky, hereby withdraw the Patronage and Protection of the House of Carrillo-Rurikovich-Tverskoi-Kholmsky granted to the Order of Prince Daniel of Kholm
